Terms of Service & End User License Agreement
Effective Date: October 25, 2026 • Last Updated: October 25, 2026
1. Acceptance of Terms
These Terms of Service and End User License Agreement (“Terms”) constitute a binding legal agreement between you (“you” or “User”) and John Slevinsky (“Licensor,” “we,” or “us”) governing your download, installation, and use of the CycleThing mobile and desktop applications for iOS, iPadOS, and macOS, as well as the CycleThing website and associated documentation (collectively, the “Software” or “Service”).
By downloading, installing, accessing, or using CycleThing, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not install or use the Software.
2. Health, Medical & Physical Safety Disclaimer
Important Safety Notice: Indoor cycling, Functional Threshold Power (FTP) testing, and high-intensity interval training involve strenuous cardiovascular and physical exertion. Consult a qualified physician before beginning or modifying any exercise program.
- No Medical Advice: CycleThing is a fitness training and telemetry tool, not a medical device. Power zones, heart rate readings, calorie estimates, Training Stress Score (TSS), and Intensity Factor (IF) metrics are provided for informational and recreational training purposes only and are not medical advice, diagnosis, or treatment.
- Physical & Equipment Safety: You are solely responsible for ensuring that your bicycle, axle mount, smart trainer, power meter, and training environment are properly installed, secured, ventilated, and maintained in accordance with the hardware manufacturer’s instructions.
- Automatic Resistance Changes: When operating in ERG, Simulation (Slope), Resistance, or Road Feel modes, CycleThing transmits resistance commands to your smart trainer that may cause sudden or substantial changes in pedaling resistance. Stop pedaling immediately if you experience dizziness, faintness, chest pain, shortness of breath, or mechanical instability.
3. Scope of License
Subject to your compliance with these Terms, Licensor grants you a personal, limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software on Apple-branded devices running iOS, iPadOS, or macOS that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.
You may not:
- Copy, redistribute, sell, rent, lease, lend, or sublicense the Software;
- Reverse engineer, decompile, disassemble, attempt to derive the source code of, modify, or create derivative works of the Software (except as and only to the extent any foregoing restriction is prohibited by applicable law); or
- Remove, obscure, or alter any copyright, trademark, or other proprietary rights notices affixed to or contained within the Software.
4. Hardware Compatibility & Third-Party Services
CycleThing communicates with compatible Bluetooth Low Energy cycling trainers, power meters, heart rate monitors, and cadence sensors, and optionally integrates with third-party platforms including Strava, TrainingPeaks, Apple Health, and Apple iCloud.
- We do not guarantee compatibility with every trainer model, firmware revision, or third-party API change.
- Your use of any third-party service (such as Strava or TrainingPeaks) is subject to that third party’s own terms of service and privacy policy. Licensor is not responsible for the availability, accuracy, or policies of third-party services.
5. User Content & Workout Files
You retain all ownership rights to the activity recordings you generate and the structured workout files you create or import into CycleThing. You are solely responsible for ensuring that you have the right to import and use any workout files you load into the Software.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. LICENSOR HEREBY DISCLAIMS ALL WARRANTIES AND CONDITIONS WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES AND/OR CONDITIONS OF MERCHANTABILITY, OF SATISFACTORY QUALITY, OF FITNESS FOR A PARTICULAR PURPOSE, OF ACCURACY, OF QUIET ENJOYMENT, AND OF NONINFRINGEMENT OF THIRD-PARTY RIGHTS.
8. Limitation of Liability
TO THE EXTENT NOT PROHIBITED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR PERSONAL INJURY, PROPERTY DAMAGE, EQUIPMENT DAMAGE, OR ANY INCIDENTAL, SPECIAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF DATA, LOSS OF WORKOUT RECORDS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SOFTWARE, HOWEVER CAUSED, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, OR OTHERWISE) AND EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL LICENSOR’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE OR FIFTY U.S. DOLLARS ($50.00), WHICHEVER IS GREATER.
